Enacted in 2010, the ACA remains in effect to this day and has served to make the private health insurance market more transparent and equitable. Elements of its mandates include subsidies that enable people of limited means to purchase coverage and a prohibition of coverage refusals due to preexisting conditions. In addition, the ACA provides for an online marketplace that allows various health plans from various insurers to be compared and selected from. The ACA has an employer mandate that requires companies with at least 50 full-time equivalent employees (FTE) to provide affordable health insurance options that exceed a “minimum standard of value” threshold for full-time workers and their kids. The ACA minimum requirements are considered met when the employer contributes 60 percent or more of covered services’ costs and employees’ contributions don’t exceed a set percentage of their household income. Those companies under the FTE 50-employee threshold do not need to offer employees coverage. However, should they make it available, they are obligated to offer it to all FTEs. Employers with 50 or less FTEs have the option of using the ACA-mandated SHOP online marketplace for selecting dental and health coverage providers for employees (100 or less FTE for New York employers).
